The sale price record ed by the auction clerk on his or her record sheets\, either on paper or electronically\, takes priority over all other re cords and shall be the official sale price of the item sold. Removal of any and all items shall be at the expense\, liabi lity and risk of the purchaser. All property must be removed within the time period announced by the Auctioneer for each auction. Property not removed within the announced time per iod will revert to the Seller for resale or disposal\, withou t refund or recourse to the bidder. Property not removed sha ll be considered abandoned and no refunds shall be issued. T he Seller\, at his or her discretion\, may chose to have uncla imed items removed or disposed of at the expense of the Bidd er who failed to collect the items. By participating in this auction\, you agree to pay the removal costs of any unclaime d items that you won in the auction. You must remove all ite ms associated with each lot. Leaving behind any items from y our purchase will result in a disposal fee assessed. Disposa l fees range from $25 - $1\,000 depending upon our costs. Ann ouncements made at the time of the sale take precedence over conflicting announcements or postings. The Auctioneer reser ves the right to determine bidding increments at his or her discretion\, and may reject a nominal or fractional bid. The Seller and the Auctioneer reserve the right to withdraw item s from sale before or during the auction without prior notic e. Persons attending the auction during preview or inspectio n period\, the auction\, or during the removal period assume a ll risks of damage\, injury\, or loss to their person and or p roperty\, and release the Auctioneer and the Auction Firm fro m liability thereof. Neither the Auction Firm nor its princi pals shall be liable for any defect in or condition of premi ses on which the auction is held. The Auction Firm is acting solely as the agent for the Seller and is not responsible f or any acts or omissions of its principals. The buyer\, assoc iates\, employees\, contractors and guests shall assume all li ability for any damage they cause during the inspection or r emoval process.  Should any litigation or mediation be comm enced between the parties to this agreement\, concerning this agreement or the associated auction\, the bidder / buyer agr ees that the court shall award the prevailing party all reas onable costs and expenses\, including reasonable attorney's f ees. The bidder / buyer agrees to reimburse the Auctioneer f or all expenses incurred in the collection of any unsatisfie d debt in conjunction with this auction. Bidder agrees that this agreement shall be governed by the laws of the state of Colorado and hereby grants sole jurisdiction and agrees to submit to the personal jurisdiction and venue of a court of subject matter jurisdiction located in El Paso County\, Color ado. Both parties waive any right to a jury trial and hereby agree to a bench trial before a judge. This agreement shall be governed in all respects by the laws of the State of Col orado. If for any reason\, a court of competent jurisdiction finds any part of this agreement to be invalid or unenforcea ble\, that part will be enforced to the maximum extent permis sible to affect the original intent of this agreement. If a part is found to be invalid or unenforceable\, the remainder of this agreement shall continue in full force and effect. S uch invalid or unenforceable part will be deemed severable f rom the other parts here and will not affect the validity or enforceability of the remaining parts. Any Bidder who fails to perform as required under these terms and conditions may be banned from this or any future auctions. By registering for any auction\, the bidder agrees to be added to the Auctio neer’s email list. If you choose to unsubscribe\, please fo llow the link at the bottom of each email to update your not ifications. The Auctioneer records all live auctions via vid eo\, audio\, still photography\, or a combination of all three. The Bidder grants the Auctioneer permission to use these re cordings and or images for any purpose. Payment Payment is d ue immediately at the conclusion of the auction. A 15% Buyer ’s Premium will be charged to all items\, regardless of pay ment method. Visa\, MasterCard\, Discover\, and American Expres s will be accepted with matching photo-identification. By pa rticipating in this auction\, buyers expressly agree that the y will not “chargeback” or “deny” a credit card purc hase. The 15% Buyer’s Premium shall apply to all credit ca rd sales. Unless you contact our office prior to 10:30am the day following the auction with an alternative form of payme nt\, the credit card that you register in the online bidding system may be charged at that time for purchases up to $1\,00 0. There is a $35 service fee that will be assessed for any credit card that is declined for a purchase. Purchases large r than $1\,000 are required to be paid by cash or wire transf er. Wire transfers will be accepted from US banks only\, and must be completed by 10:00 AM the morning following the sale . No paperwork will be provided until the payment posts to o ur account. Checks will NOT be accepted under any circumstan ces. Title for any item will not transfer until payment post s and clears. Sales Tax Sales taxes will be assessed based o n where the items are physically located. Bidders who wish t o claim a sales tax exemption MUST provide a copy of their t ax-exemption certificate PRIOR to placing any bids. Sales ta xes will NOT be credited back should the bidder fail to pre- register their exemption. Pick-Up / Shipping Items may be pi cked up at the seller's facility by appointment only. Should the auctioneer consent to a delayed pickup time\, buyers may be charged a daily storage fee\, per lot\, to be determined b y the Auctioneer. Items not picked up during the designated pick-up times will be deemed abandoned and will revert back to the Seller with no refunds. Shipping and Handling Costs: SHIPPING IS AVAILABLE FOR THIS AUCTION Shipping and handling expenses are extra and are not included in the bid price of any item. Auction winnings must be paid in full before item s can be submitted for shipping. Shipping costs are based on size\, weight\, value\, and special conditions (fragile\, hazar dous\, etc.).  Shipping is provided and invoiced by Shipping Saint.  On-Line Auctions Neither the Auctioneer nor the Se ller shall be responsible for any failure of any electronic or internet systems to accept or register a bid. Registered bidders must create a password that prevents others from usi ng their account. Bidders are responsible for ALL bids place d under their name and password. If a bid is received in the last few minutes before the scheduled closing of an item \, the timer on that item will extend\, and will continue to e xtend each time a bid is received.
