The sale price recorded by the auction clerk on his or her record sheets\, either on paper or electronically\, takes pri ority over all other records and shall be the official sale price of the item sold. Removal of any and all items shall b e at the expense\, liability and risk of the purchaser. All p roperty must be removed within the time period announced by the Auctioneer for each auction. Property not removed within the announced time period will revert to the Seller for res ale or disposal\, without refund or recourse to the bidder. P roperty not removed shall be considered abandoned and no ref unds shall be issued. The Seller\, at his or her discretion\, may chose to have unclaimed items removed or disposed of at the expense of the Bidder who failed to collect the items. B y participating in this auction\, you agree to pay the remova l costs of any unclaimed items that you won in the auction. You must remove all items associated with each lot. Leaving behind any items from your purchase will result in a disposa l fee assessed. Disposal fees range from $25 - $1\,000 depend ing upon our costs. Announcements made at the time of the sa le take precedence over conflicting announcements or posting s. The buyer\, associates\, employees\, contractors and gue sts shall assume all liability for any damage they cause dur ing the inspection or removal process.  Should any litigati on or mediation be commenced between the parties to this agr eement\, concerning this agreement or the associated auction\, the bidder / buyer agrees that the court shall award the pr evailing party all reasonable costs and expenses\, including reasonable attorney's fees. The bidder / buyer agrees to rei mburse the Auctioneer for all expenses incurred in the colle ction of any unsatisfied debt in conjunction with this aucti on. Bidder agrees that this agreement shall be governed by t he laws of the state of Colorado and hereby grants sole juri sdiction and agrees to submit to the personal jurisdiction a nd venue of a court of subject matter jurisdiction located i n El Paso County\, Colorado. Both parties waive any right to a jury trial and hereby agree to a bench trial before a judg e. This agreement shall be governed in all respects by the l aws of the State of Colorado. If for any reason\, a court of competent jurisdiction finds any part of this agreement to b e invalid or unenforceable\, that part will be enforced to th e maximum extent permissible to affect the original intent o f this agreement. If a part is found to be invalid or unenfo rceable\, the remainder of this agreement shall continue in f ull force and effect. Such invalid or unenforceable part wil l be deemed severable from the other parts here and will not affect the validity or enforceability of the remaining part s. Any Bidder who fails to perform as required under these t erms and conditions may be banned from this or any future au ctions. By registering for any auction\, the bidder agrees to be added to the Auctioneer’s email list. The Auctioneer records al l live auctions via video\, audio\, still photography\, or a co mbination of all three. The Bidder grants the Auctioneer per mission to use these recordings and or images for any purpos e. Payment Payment is due immediately at the conclusion of t he auction. A 15% Buyer’s Premium will be charged to all i tems\, regardless of payment method. Visa\, MasterCard\, Discov er\, and American Express will be accepted with matching phot o-identification. By participating in this auction\, buyers e xpressly agree that they will not “chargeback” or “den y” a credit card purchase. The 15% Buyer’s Premium shall apply to all credit card sales. Unless you contact our offi ce prior to 10:30am the day following the auction with an al ternative form of payment\, the credit card that you register in the online bidding system may be charged at that time fo r purchases up to $1\,000. There is a $35 service fee that wi ll be assessed for any credit card that is declined for a pu rchase. Purchases larger than $1\,000 are required to be paid by cash or wire transfer. Wire transfers will be accepted f rom US banks only\, and must be completed by 10:00 AM the mor ning following the sale. No paperwork will be provided until the payment posts to our account. Checks will NOT be accept ed under any circumstances. Title for any item will not tran sfer until payment posts and clears. Sales Tax Sales taxes w ill be assessed based on where the items are physically loca ted. Bidders who wish to claim a sales tax exemption MUST pr ovide a copy of their tax-exemption certificate PRIOR to pla cing any bids. Sales taxes will NOT be credited back should the bidder fail to pre-register their exemption. Pick-Up / S hipping Items may be picked up at the seller's facility by a ppointment only. Should the auctioneer consent to a delayed pickup time\, buyers may be charged a daily storage fee\, per lot\, to be determined by the Auctioneer. Shippi ng and Handling Costs: SHIPPING IS AVAILABLE FOR THIS AUCTIO N Shipping and handling expenses are extra and are not inclu ded in the bid price of any item. Auction winnings must be p aid in full before items can be submitted for shipping.
