By participating in this auction\, you agree to pay the removal costs of any u nclaimed items that you won in the auction. You must remove all items associated with each lot. Leaving behind any items from your purchase will result in a disposal fee assessed. Disposal fees range from $25 - $1\,000 depending upon our cos ts. Announcements made at the time of the sale take preceden ce over conflicting announcements or postings. The bidder / buyer agrees to reimburse the Aucti oneer for all expenses incurred in the collection of any uns atisfied debt in conjunction with this auction. Bidder agree s that this agreement shall be governed by the laws of the s tate of Colorado and hereby grants sole jurisdiction and agr ees to submit to the personal jurisdiction and venue of a co urt of subject matter jurisdiction located in El Paso County \, Colorado. Both parties waive any right to a jury trial and hereby agree to a bench trial before a judge. This agreemen t shall be governed in all respects by the laws of the State of Colorado. If for any reason\, a court of competent jurisd iction finds any part of this agreement to be invalid or une nforceable\, that part will be enforced to the maximum extent permissible to affect the original intent of this agreement . If a part is found to be invalid or unenforceable\, the rem ainder of this agreement shall continue in full force and ef fect. Such invalid or unenforceable part will be deemed seve rable from the other parts here and will not affect the vali dity or enforceability of the remaining parts. Any Bidder wh o fails to perform as required under these terms and conditi ons may be banned from this or any future auctions. The Auctioneer records all live auctions via video\, audio\, still photography\, or a combination of all three. The Bidder grants the Auctioneer permission to use t hese recordings and or images for any purpose. Payment Payme nt is due immediately at the conclusion of the auction. A 15 % Buyer’s Premium will be charged to all items\, regardless of payment method. Visa\, MasterCard\, Discover\, and American Express will be accepted with matching photo-identification . By participating in this auction\, buyers expressly agree t hat they will not “chargeback” or “deny” a credit ca rd purchase. The 15% Buyer’s Premium shall apply to all cr edit card sales. Unless you contact our office prior to 10:3 0am the day following the auction with an alternative form o f payment\, the credit card that you register in the online b idding system may be charged at that time for purchases up t o $1\,000. There is a $35 service fee that will be assessed f or any credit card that is declined for a purchase. Purchase s larger than $1\,000 are required to be paid by cash or wire transfer. Wire transfers will be accepted from US banks onl y\, and must be completed by 10:00 AM the morning following t he sale. No paperwork will be provided until the payment pos ts to our account. Checks will NOT be accepted under any cir cumstances. Title for any item will not transfer until payme nt posts and clears. Sales Tax Sales taxes will be assessed based on where the items are physically located. Bidders who wish to claim a sales tax exemption MUST provide a copy of their tax-exemption certificate PRIOR to placing any bids. On-Line Auctions Neither the Auctioneer nor the Sell er shall be responsible for any failure of any electronic or internet systems to accept or register a bid. Registered bi dders must create a password that prevents others from using their account. Bidders are responsible for ALL bids placed under their name and password.
