Property not removed within the announced time period will revert to the Seller for resale or disposal\, wit hout refund or recourse to the bidder. Property not removed shall be considered abandoned and no refunds shall be issued . The Seller\, at his or her discretion\, may chose to have un claimed items removed or disposed of at the expense of the B idder who failed to collect the items. By participating in t his auction\, you agree to pay the removal costs of any uncla imed items that you won in the auction. You must remove all items associated with each lot. Leaving behind any items fro m your purchase will result in a disposal fee assessed. Disp osal fees range from $25 - $1\,000 depending upon our costs. Announcements made at the time of the sale take precedence o ver conflicting announcements or postings. The Auctioneer re serves the right to determine bidding increments at his or h er discretion\, and may reject a nominal or fractional bid. T he Seller and the Auctioneer reserve the right to withdraw i tems from sale before or during the auction without prior no tice. The buyer\, as sociates\, employees\, contractors and guests shall assume all liability for any damage they cause during the inspection o r removal process.  Should any litigation or mediation be c ommenced between the parties to this agreement\, concerning t his agreement or the associated auction\, the bidder / buyer agrees that the court shall award the prevailing party all r easonable costs and expenses\, including reasonable attorney' s fees. The bidder / buyer agrees to reimburse the Auctionee r for all expenses incurred in the collection of any unsatis fied debt in conjunction with this auction. Bidder agrees th at this agreement shall be governed by the laws of the state of Colorado and hereby grants sole jurisdiction and agrees to submit to the personal jurisdiction and venue of a court of subject matter jurisdiction located in El Paso County\, Co lorado. Both parties waive any right to a jury trial and her eby agree to a bench trial before a judge. This agreement sh all be governed in all respects by the laws of the State of Colorado. If for any reason\, a court of competent jurisdicti on finds any part of this agreement to be invalid or unenfor ceable\, that part will be enforced to the maximum extent per missible to affect the original intent of this agreement. If a part is found to be invalid or unenforceable\, the remaind er of this agreement shall continue in full force and effect . Such invalid or unenforceable part will be deemed severabl e from the other parts here and will not affect the validity or enforceability of the remaining parts. Any Bidder who fa ils to perform as required under these terms and conditions may be banned from this or any future auctions. By registeri ng for any auction\, the bidder agrees to be added to the Auc tioneer’s email list. If you choose to unsubscribe\, please follow the link at the bottom of each email to update your notifications. The Auctioneer records all live auctions via video\, audio\, still photography\, or a combination of all thr ee. The Bidder grants the Auctioneer permission to use these recordings and or images for any purpose. Payment Payment i s due immediately at the conclusion of the auction. A 15% Bu yer’s Premium will be charged to all items\, regardless of payment method. Visa\, MasterCard\, Discover\, and American Exp ress will be accepted with matching photo-identification. By participating in this auction\, buyers expressly agree that they will not “chargeback” or “deny” a credit card p urchase. The 15% Buyer’s Premium shall apply to all credit card sales. Unless you contact our office prior to 10:30am the day following the auction with an alternative form of pa yment\, the credit card that you register in the online biddi ng system may be charged at that time for purchases up to $1 \,000. There is a $35 service fee that will be assessed for a ny credit card that is declined for a purchase. Purchases la rger than $1\,000 are required to be paid by cash or wire tra nsfer. Wire transfers will be accepted from US banks only\, a nd must be completed by 10:00 AM the morning following the s ale. No paperwork will be provided until the payment posts t o our account. Checks will NOT be accepted under any circums tances. Title for any item will not transfer until payment p osts and clears. Sales Tax Sales taxes will be assessed base d on where the items are physically located. Bidders who wis h to claim a sales tax exemption MUST provide a copy of thei r tax-exemption certificate PRIOR to placing any bids. Sales taxes will NOT be credited back should the bidder fail to p re-register their exemption. Pick-Up / Shipping Items may be picked up at the seller's facility by appointment only. Shipping and Handling Cost s: SHIPPING IS AVAILABLE FOR THIS AUCTION Shipping and handl ing expenses are extra and are not included in the bid price of any item. Auction winnings must be paid in full before i tems can be submitted for shipping. Shipping costs are based on size\, weight\, value\, and special conditions (fragile\, ha zardous\, etc.).  Shipping is provided and invoiced by Shipp ing Saint.  On-Line Auctions Neither the Auctioneer nor the Seller shall be responsible for any failure of any electron ic or internet systems to accept or register a bid. Register ed bidders must create a password that prevents others from using their account. Bidders are responsible for ALL bids pl aced under their name and password.
