The sale price reco rded by the auction clerk on his or her record sheets\, eithe r on paper or electronically\, takes priority over all other records and shall be the official sale price of the item sol d. Removal of any and all items shall be at the expense\, lia bility and risk of the purchaser. All property must be remov ed within the time period announced by the Auctioneer for ea ch auction. Property not removed within the announced time p eriod will revert to the Seller for resale or disposal\, with out refund or recourse to the bidder. Property not removed s hall be considered abandoned and no refunds shall be issued. The Seller\, at his or her discretion\, may chose to have unc laimed items removed or disposed of at the expense of the Bi dder who failed to collect the items. By participating in th is auction\, you agree to pay the removal costs of any unclai med items that you won in the auction. You must remove all i tems associated with each lot. Leaving behind any items from your purchase will result in a disposal fee assessed. Dispo sal fees range from $25 - $1\,000 depending upon our costs. A nnouncements made at the time of the sale take precedence ov er conflicting announcements or postings. The Auctioneer res erves the right to determine bidding increments at his or he r discretion\, and may reject a nominal or fractional bid. Th e Seller and the Auctioneer reserve the right to withdraw it ems from sale before or during the auction without prior not ice. Persons attending the auction during preview or inspect ion period\, the auction\, or during the removal period assume all risks of damage\, injury\, or loss to their person and or property\, and release the Auctioneer and the Auction Firm f rom liability thereof. Neither the Auction Firm nor its prin cipals shall be liable for any defect in or condition of pre mises on which the auction is held. The Auction Firm is acti ng solely as the agent for the Seller and is not responsible for any acts or omissions of its principals. The buyer\, ass ociates\, employees\, contractors and guests shall assume all liability for any damage they cause during the inspection or removal process.  Should any litigation or mediation be co mmenced between the parties to this agreement\, concerning th is agreement or the associated auction\, the bidder / buyer a grees that the court shall award the prevailing party all re asonable costs and expenses\, including reasonable attorney's fees. The bidder / buyer agrees to reimburse the Auctioneer for all expenses incurred in the collection of any unsatisf ied debt in conjunction with this auction. Bidder agrees tha t this agreement shall be governed by the laws of the state of Colorado and hereby grants sole jurisdiction and agrees t o submit to the personal jurisdiction and venue of a court o f subject matter jurisdiction located in El Paso County\, Col orado. Both parties waive any right to a jury trial and here by agree to a bench trial before a judge. This agreement sha ll be governed in all respects by the laws of the State of C olorado. If for any reason\, a court of competent jurisdictio n finds any part of this agreement to be invalid or unenforc eable\, that part will be enforced to the maximum extent perm issible to affect the original intent of this agreement. If a part is found to be invalid or unenforceable\, the remainde r of this agreement shall continue in full force and effect. Such invalid or unenforceable part will be deemed severable from the other parts here and will not affect the validity or enforceability of the remaining parts. Any Bidder who fai ls to perform as required under these terms and conditions m ay be banned from this or any future auctions. By registerin g for any auction\, the bidder agrees to be added to the Auct ioneer’s email list. The Auctioneer records all live auctions via v ideo\, audio\, still photography\, or a combination of all thre e. The Bidder grants the Auctioneer permission to use these recordings and or images for any purpose. Payment Payment is due immediately at the conclusion of the auction. A 15% Buy er’s Premium will be charged to all items\, regardless of p ayment method. Visa\, MasterCard\, Discover\, and American Expr ess will be accepted with matching photo-identification. By participating in this auction\, buyers expressly agree that t hey will not “chargeback” or “deny” a credit card pu rchase. The 15% Buyer’s Premium shall apply to all credit card sales. Unless you contact our office prior to 10:30am t he day following the auction with an alternative form of pay ment\, the credit card that you register in the online biddin g system may be charged at that time for purchases up to $1\, 000. There is a $35 service fee that will be assessed for an y credit card that is declined for a purchase. Purchases lar ger than $1\,000 are required to be paid by cash or wire tran sfer. Wire transfers will be accepted from US banks only\, an d must be completed by 10:00 AM the morning following the sa le. No paperwork will be provided until the payment posts to our account. Checks will NOT be accepted under any circumst ances. Title for any item will not transfer until payment po sts and clears. Sales Tax Sales taxes will be assessed based on where the items are physically located. Bidders who wish to claim a sales tax exemption MUST provide a copy of their tax-exemption certificate PRIOR to placing any bids. Sales taxes will NOT be credited back should the bidder fail to pr e-register their exemption. Pick-Up / Shipping Items may be picked up at the seller's facility by appointment only. Shou ld the auctioneer consent to a delayed pickup time\, buyers m ay be charged a daily storage fee\, per lot\, to be determined by the Auctioneer. Items not picked up during the designate d pick-up times will be deemed abandoned and will revert bac k to the Seller with no refunds. Shipping and Handling Costs : SHIPPING IS AVAILABLE FOR THIS AUCTION Shipping and handli ng expenses are extra and are not included in the bid price of any item. Auction winnings must be paid in full before it ems can be submitted for shipping. Shipping costs are based on size\, weight\, value\, and special conditions (fragile\, haz ardous\, etc.).  Shipping is provided and invoiced by Shippi ng Saint.  On-Line Auctions Neither the Auctioneer nor the Seller shall be responsible for any failure of any electroni c or internet systems to accept or register a bid. Registere d bidders must create a password that prevents others from u sing their account. Bidders are responsible for ALL bids pla ced under their name and password. This is a Public Auction and as such\, all qualified bidders may bid\, including Schur Success owners\, family members and employees. Online auction s use a “Dynamic” ending process. If a bid is received i n the last few minutes before the scheduled closing of an it em\, the timer on that item will extend\, and will continue to extend each time a bid is received.
