Leaving behind any items from your purchase will result in a disposal fee assessed. Disposal fees range from $25 - $1\,000 depending upon our costs. Bidder agrees that this agreement sh all be governed by the laws of the state of Colorado and her eby grants sole jurisdiction and agrees to submit to the per sonal jurisdiction and venue of a court of subject matter ju risdiction located in El Paso County\, Colorado. Both parties waive any right to a jury trial and hereby agree to a bench trial before a judge. This agreement shall be governed in a ll respects by the laws of the State of Colorado. If for any reason\, a court of competent jurisdiction finds any part of this agreement to be invalid or unenforceable\, that part wi ll be enforced to the maximum extent permissible to affect t he original intent of this agreement. If a part is found to be invalid or unenforceable\, the remainder of this agreement shall continue in full force and effect. Such invalid or un enforceable part will be deemed severable from the other par ts here and will not affect the validity or enforceability o f the remaining parts. Any Bidder who fails to perform as re quired under these terms and conditions may be banned from t his or any future auctions. The A uctioneer records all live auctions via video\, audio\, still photography\, or a combination of all three. The Bidder grant s the Auctioneer permission to use these recordings and or i mages for any purpose. Payment Payment is due immediately at the conclusion of the auction. An 18.5% Buyer’s Premium w ill be charged to all items\, with an optional cash discount of 3.5%. Visa\, MasterCard\, Discover\, and American Express wi ll be accepted with matching photo-identification. By partic ipating in this auction\, buyers expressly agree that they wi ll not “chargeback” or “deny” a credit card purchase . The 18.5% Buyer’s Premium shall apply to all credit card sales. Shipping and Handling Costs: SHIPPING IS AV AILABLE FOR THIS AUCTION Shipping and handling expenses are extra and are not included in the bid price of any item. Auc tion winnings must be paid in full before items can be submi tted for shipping. Shipping costs are based on size\, weight\, value\, and special conditions (fragile\, hazardous\, etc.).  Shipping is provided and invoiced by Shipping Saint.  Reta il Delivery & Administrative Fee: The State of Colorado ha s mandated that businesses collect a retail delivery fee of .29 per invoice for items shipped by vehicle within the stat e. The state mandates businesses to collect\, track\, report\, and remit this fee with no credit or compensation to the bus iness.  The cost for us to administer this tax collection i s more than four times the actual fee. Therefore\, we must ad d a $1 surcharge\, which includes the fee\, in order to adhere to this unfunded mandate.  If you do not support this fee \, please contact your state representatives. On-Line Auction s Neither the Auctioneer nor the Seller shall be responsible for any failure of any electronic or internet systems to ac cept or register a bid. Registered bidders must create a pas sword that prevents others from using their account. Bidders are responsible for ALL bids placed under their name and pa ssword. This is a Public Auction and as such\, all qualified bidders may bid\, including Schur Success owners\, family memb ers and employees. Online auctions use a “Dynamic” endin g process.
