The bidder / buyer agrees to reimburse the Auctioneer for all expenses incurred in the co llection of any unsatisfied debt in conjunction with this au ction. Bidder agrees that this agreement shall be governed b y the laws of the state of Colorado and hereby grants sole j urisdiction and agrees to submit to the personal jurisdictio n and venue of a court of subject matter jurisdiction locate d in El Paso County\, Colorado. Both parties waive any right to a jury trial and hereby agree to a bench trial before a j udge. This agreement shall be governed in all respects by th e laws of the State of Colorado. If for any reason\, a court of competent jurisdiction finds any part of this agreement t o be invalid or unenforceable\, that part will be enforced to the maximum extent permissible to affect the original inten t of this agreement. If a part is found to be invalid or une nforceable\, the remainder of this agreement shall continue i n full force and effect. Such invalid or unenforceable part will be deemed severable from the other parts here and will not affect the validity or enforceability of the remaining p arts. Any Bidder who fails to perform as required under thes e terms and conditions may be banned from this or any future auctions. The Auctioneer records all live auctions via video\, audio\, still photography\, or a combination of all three. The Bidder grants the Auctioneer permission to use these recordings and or images for any pur pose. Payment Payment is due immediately at the conclusion o f the auction. An 18.5% Buyer’s Premium will be charged to all items\, with an optional cash discount of 3.5%. Visa\, Ma sterCard\, Discover\, and American Express will be accepted wi th matching photo-identification. By participating in this a uction\, buyers expressly agree that they will not “chargeb ack” or “deny” a credit card purchase. The 18.5% Buyer ’s Premium shall apply to all credit card sales. Unless yo u contact our office prior to 10:30am the day following the auction with an alternative form of payment\, the credit card that you register in the online bidding system may be charg ed at that time for purchases up to $1\,000. There is a $35 s ervice fee that will be assessed for any credit card that is declined for a purchase. Purchases larger than $1\,000 are r equired to be paid by cash or wire transfer. Wire transfers will be accepted from US banks only\, and must be completed b y 10:00 AM the morning following the sale. No paperwork will be provided until the payment posts to our account. Checks will NOT be accepted under any circumstances. Title for any item will not transfer until payment posts and clears. Shipping and Handling Costs: SHIPPING IS AVAILABLE FOR THIS AUCTION Shipping and handling expenses are extra and are not included in the bid price of any item. Shipping costs are based on size\, weight\, value\, and speci al conditions (fragile\, hazardous\, etc.).  Shipping is prov ided and invoiced by Shipping Saint.  Retail Delivery & Adm inistrative Fee: The State of Colorado has mandated that b usinesses collect a retail delivery fee of .29 per invoice f or items shipped by vehicle within the state. The state mand ates businesses to collect\, track\, report\, and remit this fe e with no credit or compensation to the business.  The cost for us to administer this tax collection is more than four times the actual fee. Therefore\, we must add a $1 surcharge\, which includes the fee\, in order to adhere to this unfunded mandate.  If you do not support this fee\, please contact your state representatives. On-Line Auctions Neither the Auc tioneer nor the Seller shall be responsible for any failure of any electronic or internet systems to accept or register a bid. Registered bidders must create a password that preven ts others from using their account. Bidders are responsible for ALL bids placed under their name and password. This is a Public Auction and as such\, all qualified bidders may bid\, including Schur Success owners\, family members and employees . Online auctions use a “Dynamic” ending process. If a b id is received in the last few minutes before the scheduled closing of an item\, the timer on that item will extend\, and will continue to extend each time a bid is received. Once th e bidding stops\, and the timer runs out\, that item will be e ligible to close. In some cases\, items are “linked”\, kee ping one item open for bidding when a different item in the auction has been extended due to active bidding.
