 uary 1\, 2025 The State of Colorado\, in an effort to hinder f
 irearms sales and ownership\, passed new laws in 2025.  Amon
 g these new laws is an EXCISE TAX of 6.5%\, in ADDITION to 
 standard sales tax\,  on all firearms sales\, ammunition sal
 es\, and firearms parts. The State has also adopted new laws 
 requiring that firearms dealers be licensed by the State\, de
 spite already being licensed and under the supervision of th
 e Federal Government. This new requirement forces lawfully o
 perating\, already licensed dealers to pay an additional annu
 al fee*\, submit to and pay for redundant background checks\, 
 and provide state approved training to staff.  These unfund
 ed mandates add yet another layer of cost and time to small 
 businesses. As a result of these additional costs and burden
 s\, we have no choice but to assess an additional $12 fee to 
 the final sale price of EACH firearm sold. In addition\, it i
 s now illegal to store an unsecured firearm in a vehicle. We
  have lockboxes available for sale in our office. *The law a
 llows for the new state agency to raise the fee annually\, wi
 th no limit. Though we've had to raise our buyer's premium s
 lightly to 18.5%\, we now offer a discount for CASH purchases
 . If you pay us with cash\, we will reduce your buyer's premi
 um to 15%. Please let us know if you would like to use this 
 option on your purchase. The State is also tracking firearms
  sales made with credit cards. We highly recommend paying fo
 r these purchases with cash.  Cash or Wire Transfer ONLY wi
 ll be accepted for purchases\, including titled vehicles\, exc
 eeding $1\,200. Credit cards will NOT be accepted. If you wis
 h to pay for your purchases by cash or a credit card that is
  different from the one used to register for the auction\, pl
 ease notify us prior to 10am the day following the auction. 
 All credit cards on file may be processed for purchases up t
 o $1\,200 at 10:30am on the day following the auction unless 
 payment arrangements are made with our office. All weights\,

 ms and Conditions constitute a CONTRACT between you\, the bid
 der\, and us\, the Auctioneer. Do not submit any bids unless y
 ou understand and agree to ALL of the terms of this contract
 . Schur Success Realty & Auction\, LLC\; Schur Success Auction
  & Appraisal\, Inc.\; and Schur Success Group shall be known i
 ndividually and collectively as “Auctioneers”\, or “Auc
 tion Firm”. All bidders must be 21 or older for the purcha
 se of firearms and ammunition\, and provide identification as
  verification upon request. All bidders and others participa
 ting in this auction agree that they have read these terms a
 nd agree to be bound by and abide by these terms thereby. Bi
 dder and his or her agents and employees agree to assume all
  risks of damage to person or property. Bidder and his or he
 r agents and employees specifically release and forever inde
 mnify Auctioneer\, its employees\, agents\, and assigns\, from a
 ny liability and causes of action. All property is sold “a
 s is\, where is” without any warranty or guarantee\, express
 ed or implied. ALL SALES ARE FINAL. THERE ARE NO REFUNDS\, EX
 CHANGES or REFUSALS. As the highest bidder\, you are the buye
 r and are bound by the terms and conditions of this agreemen
 t and sale. The BUYER assumes full responsibility for any it
 em purchased AT THE TIME IT IS SOLD\, including the security 
 of the item(s). Though we will do our best to maintain secur
 ity of the items\, there will be no refunds for stolen or mis
 sing items once the Auctioneer announces “sold”. In no e
 vent shall a bidder or buyer hold the Auctioneer responsible
  for having made or implied any warranty or merchantability 
 or fitness for any specific purpose. The Auctioneer is actin
 g solely as an agent for the Seller. The Auctioneer shall as
 sume no liability for representations made\, or information p
 rovided by the Seller. The Seller & Auctioneer reserve the r
 ight to accept or reject any or all bids\, or to remove any o
 r all items from the auction at any time. This is a Public A
 uction and as such\, all qualified bidders may bid\, including
  Schur Success owners\, family members and employees. The Auc
 tioneer may bid on behalf of the Seller up to the reserve\, w
 hether or not the reserve is published. When preview or insp
 ection is available\, bidders are encouraged to inspect all i
 tems before bidding. Public inspection & preview information
  is posted on our website for each sale. Bid cards and bidde
 r registration numbers are issued solely to individuals and 
 are not transferable. Others are not authorized to use your 
 bidder registration. Should you allow others to bid under yo
 ur number\, you will be fully responsible for all bids they m
 ake as though you made them yourself. The sale price recorde
 d by the auction clerk on his or her record sheets\, either o
 n paper or electronically\, takes priority over all other rec
 ords and shall be the official sale price of the item sold. 
 Removal of any and all items shall be at the expense\, liabil
 ity and risk of the purchaser. All property must be removed 
 within the time period announced by the Auctioneer for each 
 auction. Property not removed within the announced time peri
 od will revert to the Seller for resale or disposal\, without
  refund or recourse to the bidder. Property not removed shal
 l be considered abandoned and no refunds shall be issued. Th
 e Seller\, at his or her discretion\, may chose to have unclai
 med items removed or disposed of at the expense of the Bidde
 r who failed to collect the items. By participating in this 
 auction\, you agree to pay the removal costs of any unclaimed
  items that you won in the auction. You must remove all item
 s associated with each lot. Leaving behind any items from yo
 ur purchase will result in a disposal fee assessed. Disposal
  fees range from $25 - $1\,000 depending upon our costs. Anno
 uncements made at the time of the sale take precedence over 
 conflicting announcements or postings. The Auctioneer reserv
 es the right to determine bidding increments at his or her d
 iscretion\, and may reject a nominal or fractional bid. The S
 eller and the Auctioneer reserve the right to withdraw items
  from sale before or during the auction without prior notice
 . Persons attending the auction during preview or inspection
  period\, the auction\, or during the removal period assume al
 l risks of damage\, injury\, or loss to their person and or pr
 operty\, and release the Auctioneer and the Auction Firm from
  liability thereof. Neither the Auction Firm nor its princip
 als shall be liable for any defect in or condition of premis
 es on which the auction is held. The Auction Firm is acting 
 solely as the agent for the Seller and is not responsible fo
 r any acts or omissions of its principals. The buyer\, associ
 ates\, employees\, contractors and guests shall assume all lia
 bility for any damage they cause during the inspection or re
 moval process. Should any litigation or mediation be commenc
 ed between the parties to this agreement\, concerning this ag
 reement or the associated auction\, the bidder / buyer agrees
  that the court shall award the prevailing party all reasona
 ble costs and expenses\, including reasonable attorney's fees
 . The bidder / buyer agrees to reimburse the Auctioneer for 
 all expenses incurred in the collection of any unsatisfied d
 ebt in conjunction with this auction. Bidder agrees that thi
 s agreement shall be governed by the laws of the state of Co
 lorado and hereby grants sole jurisdiction and agrees to sub
 mit to the personal jurisdiction and venue of a court of sub
 ject matter jurisdiction located in El Paso County\, Colorado
 . Both parties waive any right to a jury trial and hereby ag
 ree to a bench trial before a judge. This agreement shall be
  governed in all respects by the laws of the State of Colora
 do. If for any reason\, a court of competent jurisdiction fin
 ds any part of this agreement to be invalid or unenforceable
 \, that part will be enforced to the maximum extent permissib
 le to affect the original intent of this agreement. If a par
 t is found to be invalid or unenforceable\, the remainder of 
 this agreement shall continue in full force and effect. Such
  invalid or unenforceable part will be deemed severable from
  the other parts here and will not affect the validity or en
 forceability of the remaining parts. Any Bidder who fails to
  perform as required under these terms and conditions may be
  banned from this or any future auctions. By registering for
  any auction\, the bidder agrees to be added to the Auctionee
 r’s email list. If you choose to unsubscribe\, please follo
 w the link at the bottom of each email to update your notifi
 cations. The Auctioneer records all live auctions via video\,
  audio\, still photography\, or a combination of all three. Th
 e Bidder grants the Auctioneer permission to use these recor
 dings and or images for any purpose. Payment Payment is due 
 immediately at the conclusion of the auction. A 18.5% Buyer
 s Premium will be charged to all items\, discounted to 15% 
 for cash payments. Visa\, MasterCard\, Discover\, and American 
 Express will be accepted with matching photo-identification.
  By participating in this auction\, buyers expressly agree th
 at they will not “chargeback” or “deny” a credit car
 d purchase. The 15% Buyer’s Premium shall apply to all cre
 dit card sales. Unless you contact our office prior to 10:30
 am the day following the auction with an alternative form of
  payment\, the credit card that you register in the online bi
 dding system may be charged at that time for purchases up to
  $1\,000. There is a $35 service fee that will be assessed fo
 r any credit card that is declined for a purchase. Purchases
  larger than $1\,000 are required to be paid by cash or wire 
 transfer. Wire transfers will be accepted from US banks only
 \, and must be completed by 10:00 AM the morning following th
 e sale. No paperwork will be provided until the payment post
 s to our account. Checks will NOT be accepted under any circ
 umstances. Title for any item will not transfer until paymen
 t posts and clears. Sales Tax Sales taxes will be assessed b
 ased on where the items are physically located. Bidders who 
 wish to claim a sales tax exemption MUST provide a copy of t
 heir tax-exemption certificate PRIOR to placing any bids. Sa
 les taxes will NOT be credited back should the bidder fail t
 o pre-register their exemption. An additional 6.5% excise ta
 x will be collected on firearms and ammunition sales under n
 ew laws passed in Colorado.  Pick-Up / Shipping Items may b
 e picked up at the seller's facility by appointment only. Sh
 ould the auctioneer consent to a delayed pickup time\, buyers
  may be charged a daily storage fee\, per lot\, to be determin
 ed by the Auctioneer. Items not picked up during the designa
 ted pick-up times will be deemed abandoned and will revert b
 ack to the Seller with no refunds. Shipping and Handling Cos
 ts: Shipping and handling expenses are extra and are not inc
 luded in the bid price of any item. Auctions winnings must b
 e paid in full before items can be submitted for shipping. S
 hipping costs are based on size\, weight\, value\, and special 
 conditions (fragile\, hazardous\, etc.). Shipping is provided 
 and invoiced by Shipping Saint. Retail Delivery & Administra
 tive Fee: The State of Colorado has mandated that businesses
  collect a retail delivery fee of .29 per invoice for items 
 shipped by vehicle within the state. The state mandates busi
 nesses to collect\, track\, report\, and remit this fee with no
  credit or compensation to the business.  The cost for us t
 o administer this tax collection is more than four times the
  actual fee. Therefore\, we must add a $1 surcharge\, which in
 cludes the fee\, in order to adhere to this unfunded mandate.
   If you do not support this fee\, please contact your state
  representatives.  On-Line Auctions Neither the Auctioneer 
 nor the Seller shall be responsible for any failure of any e
 lectronic or internet systems to accept or register a bid. R
 egistered bidders must create a password that prevents other
 s from using their account. Bidders are responsible for ALL 
 bids placed under their name and password. This is a Public 
 Auction and as such\, all qualified bidders may bid\, includin
 g Schur Success owners\, family members and employees. Online
  auctions use a “Dynamic” ending process. If a bid is re
 ceived in the last few minutes before the scheduled closing 
 of an item\, the timer on that item will extend\, and will con
 tinue to extend each time a bid is received. Once the biddin
 g stops\, and the timer runs out\, that item will be eligible 
 to close. In some cases\, items are “linked”\, keeping one
  item open for bidding when a different item in the auction 
 has been extended due to active bidding. It is the Bidder's 
 responsibility to determine condition\, age\, genuineness\, val
 ue or any other determinative factor of all items. Auctionee
 r may attempt to describe the merchandise in advertising\, on
  the internet and at the auction but makes no representation
 s. In no event shall the Auctioneer be held responsible for 
 having made or implied any warranty of merchantability or fi
 tness for a particular purpose. Auctioneer does not guarante
 e any appraisals\, gradings or certifications. If you have an
 y questions about the merchandise\, ASK YOUR QUESTION BEFORE 
 PLACING BIDS. Bidders shall be the sole judges of value. It 
 is Bidder's responsibility to determine if any item is legal
  where they live. By placing a bid\, Bidder acknowledges that
  they have inspected the items to their satisfaction or choo
 ses to not examine them at their sole risk. Even though an i
 tem may display as "sold" on the internet\, no sales are fina
 l until they are certified by the Auctioneer and the bidder 
 receives an invoice. Auctioneer reserves the right to cancel
  any or all sales and resell the items in whatever manner he
  or she chooses. Bidding increments are automatically adjust
 ed based on the chart provided for each auction and are subj
 ect to change at the sole discretion of Auctioneer. Bids can
 not and will not be removed or altered\, unless in the opinio
 n of the auctioneer\, the bidder can establish that the bid w

 ioneer holds a current and valid Federal Firearms License (F
 FL) and will comply with all laws federal\, state\, and local.
  Though we may sell firearms that are legal in our jurisdict
 ion\, they may not be legal in the bidder’s jurisdiction. I
 t is the sole responsibility and obligation of the buyer to 
 ensure the legality of a firearm in their jurisdiction. A th
 irty percent (30%) restocking fee will apply if a firearm pu
 rchased cannot be possessed in the buyer’s jurisdiction an
 d must be returned to our inventory. Firearms must be picked
  up in person at our office in Monument\, Colorado\, or they c
 an be shipped to an FFL dealer of the bidder’s choosing. F
 irearms shipped will incur shipping and handling charges as 
 outlined above. Firearms and all associated shipping and han
 dling costs must be paid prior to shipping. The buyer is sol
 ely responsible for complying with firearms laws in the juri
 sdiction where the firearms will be received. The buyer must
  notify the recipient FFL dealer of the transaction before t
 he Auctioneer makes any shipping arrangements. Buyers wishin
 g to pick up firearms in our office must make an appointment
 . Buyers will be subject to a mandatory CBI background check
  for each auction\, though multiple firearms bought at the sa
 me time will require only one such check. The buyer will pay
  the cost of the background check ($15.00) as required by CB
 I. Valid identification will be required. Contact the auctio
 n to determine if your identification is acceptable. Purchas
 es must be paid in full prior to a background check being co
 nducted. If a buyer fails a background check\, the Auctioneer
  shall retain the firearms and refund the purchase price les
 s a thirty-percent (30%) restocking fee. Firearms will be so
 ld ONLY to the registered bidder. They will not be sold to a
 nother person\, nor will a name be changed on any forms inclu
 ding bidder registrations or invoices. If you attempt to cha
 nge a transaction to a different person\, that is considered 
 a straw purchase. If you know you will not pass a background
  check\, do not bid. Straw purchases are absolutely forbidden
 . If the Auctioneer has any reason to suspect that a firearm
  will be given/sold/transferred illegally to a third party\, 
 he must\, by law\, refuse the sale and report his suspicions t
 o the proper authorities. Straw purchases are a federal offe
 nse. Used firearms are sold untested. We do not attempt to f
 ire or test any weapon that we sell. We highly recommend tha
 t you have all used firearms inspected by a qualified profes
 sional before operating.
