Leav ing behind any items from your purchase will result in a dis posal fee assessed. Disposal fees range from $25 - $1\,000 de pending upon our costs. The bidder / buyer agrees to reimburse the Auctioneer for all expenses incurred in the c ollection of any unsatisfied debt in conjunction with this a uction. Bidder agrees that this agreement shall be governed by the laws of the state of Colorado and hereby grants sole jurisdiction and agrees to submit to the personal jurisdicti on and venue of a court of subject matter jurisdiction locat ed in El Paso County\, Colorado. Both parties waive any right to a jury trial and hereby agree to a bench trial before a judge. This agreement shall be governed in all respects by t he laws of the State of Colorado. If for any reason\, a court of competent jurisdiction finds any part of this agreement to be invalid or unenforceable\, that part will be enforced t o the maximum extent permissible to affect the original inte nt of this agreement. If a part is found to be invalid or un enforceable\, the remainder of this agreement shall continue in full force and effect. Such invalid or unenforceable part will be deemed severable from the other parts here and will not affect the validity or enforceability of the remaining parts. Any Bidder who fails to perform as required under the se terms and conditions may be banned from this or any futur e auctions. The Auctioneer record s all live auctions via video\, audio\, still photography\, or a combination of all three. The Bidder grants the Auctioneer permission to use these recordings and or images for any pu rpose. Payment Payment is due immediately at the conclusion of the auction. An 18.5% Buyer’s Premium will be charged t o all items\, with an optional cash discount of 3.5%. Visa\, M asterCard\, Discover\, and American Express will be accepted w ith matching photo-identification. By participating in this auction\, buyers expressly agree that they will not “charge back” or “deny” a credit card purchase. The 18.5% Buye r’s Premium shall apply to all credit card sales. Unless y ou contact our office prior to 10:30am the day following the auction with an alternative form of payment\, the credit car d that you register in the online bidding system may be char ged at that time for purchases up to $1\,000. There is a $35 service fee that will be assessed for any credit card that i s declined for a purchase. Purchases larger than $1\,000 are required to be paid by cash or wire transfer. Wire transfers will be accepted from US banks only\, and must be completed by 10:00 AM the morning following the sale. No paperwork wil l be provided until the payment posts to our account. Checks will NOT be accepted under any circumstances. Title for any item will not transfer until payment posts and clears. Shipping and Handling Costs: SHIPPING IS AVAILABLE FOR THIS AUCTION Shipping and handling expenses are extra and are no t included in the bid price of any item. Auction winnings mu st be paid in full before items can be submitted for shippin g. Shipping costs are based on size\, weight\, value\, and spec ial conditions (fragile\, hazardous\, etc.).  Shipping is pro vided and invoiced by Shipping Saint.  Retail Delivery & Ad ministrative Fee: The State of Colorado has mandated that businesses collect a retail delivery fee of .29 per invoice for items shipped by vehicle within the state. The state man dates businesses to collect\, track\, report\, and remit this f ee with no credit or compensation to the business.  The cos t for us to administer this tax collection is more than four times the actual fee. Therefore\, we must add a $1 surcharge \, which includes the fee\, in order to adhere to this unfunde d mandate.  If you do not support this fee\, please contact your state representatives. On-Line Auctions Neither the Au ctioneer nor the Seller shall be responsible for any failure of any electronic or internet systems to accept or register a bid. Registered bidders must create a password that preve nts others from using their account. Bidders are responsible for ALL bids placed under their name and password. This is a Public Auction and as such\, all qualified bidders may bid\, including Schur Success owners\, family members and employee s. Online auctions use a “Dynamic” ending process. If a bid is received in the last few minutes before the scheduled closing of an item\, the timer on that item will extend\, and will continue to extend each time a bid is received.
