 only. Effective January 1\, 2025 The State of Colorado\, in an
  effort to hinder firearms sales and ownership\, passed new l
 aws in 2025.  Among these new laws is an EXCISE TAX of 6.
 5%\, in ADDITION to standard sales tax\,  on all firearms sa
 les\, ammunition sales\, and firearms parts. The State has als
 o adopted new laws requiring that firearms dealers be licens
 ed by the State\, despite already being licensed and under th
 e supervision of the Federal Government. This new requiremen
 t forces lawfully operating\, already licensed dealers to pay
  an additional annual fee*\, submit to and pay for redundant 
 background checks\, and provide state approved training to st
 aff.  These unfunded mandates add yet another layer of cost
  and time to small businesses. As a result of these addition
 al costs and burdens\, we have no choice but to assess an add
 itional $12 fee to the final sale price of EACH firearm sold
 . In addition\, it is now illegal to store an unsecured firea
 rm in a vehicle. We have lockboxes available for sale in our
  office. *The law allows for the new state agency to raise t
 he fee annually\, with no limit. Though we've had to raise ou
 r buyer's premium slightly to 18.5%\, we now offer a discount
  for CASH purchases. If you pay us with cash\, we will reduce
  your buyer's premium to 15%. Please let us know if you woul
 d like to use this option on your purchase. The State is als
 o tracking firearms sales made with credit cards. We highly 
 recommend paying for these purchases with cash.  Cash or Wi
 re Transfer ONLY will be accepted for purchases\, including t
 itled vehicles\, exceeding $1\,200. Credit cards will NOT be a
 ccepted. If you wish to pay for your purchases by cash or a 
 credit card that is different from the one used to register 
 for the auction\, please notify us prior to 10am the day foll
 owing the auction. All credit cards on file may be processed
  for purchases up to $1\,200 at 10:30am on the day following 
 the auction unless payment arrangements are made with our of

 ONDITIONS These Terms and Conditions constitute a CONTRACT b
 etween you\, the bidder\, and us\, the Auctioneer. Do not submi
 t any bids unless you understand and agree to ALL of the ter
 ms of this contract. Schur Success Realty & Auction\, LLC\; Sc
 hur Success Auction & Appraisal\, Inc.\; and Schur Success Gro
 up shall be known individually and collectively as “Auctio
 neers”\, or “Auction Firm”. All bidders must be 21 or o
 lder for the purchase of firearms and ammunition\, and provid
 e identification as verification upon request. All bidders a
 nd others participating in this auction agree that they have
  read these terms and agree to be bound by and abide by thes
 e terms thereby. Bidder and his or her agents and employees 
 agree to assume all risks of damage to person or property. B
 idder and his or her agents and employees specifically relea
 se and forever indemnify Auctioneer\, its employees\, agents\, 
 and assigns\, from any liability and causes of action. All pr
 operty is sold “as is\, where is” without any warranty or
  guarantee\, expressed or implied. ALL SALES ARE FINAL. THERE
  ARE NO REFUNDS\, EXCHANGES or REFUSALS. As the highest bidde
 r\, you are the buyer and are bound by the terms and conditio
 ns of this agreement and sale. The BUYER assumes full respon
 sibility for any item purchased AT THE TIME IT IS SOLD\, incl
 uding the security of the item(s). Though we will do our bes
 t to maintain security of the items\, there will be no refund
 s for stolen or missing items once the Auctioneer announces 
 “sold”. In no event shall a bidder or buyer hold the Auc
 tioneer responsible for having made or implied any warranty 
 or merchantability or fitness for any specific purpose. The 
 Auctioneer is acting solely as an agent for the Seller. The 
 Auctioneer shall assume no liability for representations mad
 e\, or information provided by the Seller. The Seller & Aucti
 oneer reserve the right to accept or reject any or all bids\,
  or to remove any or all items from the auction at any time.
  This is a Public Auction and as such\, all qualified bidders
  may bid\, including Schur Success owners\, family members and
  employees. The Auctioneer may bid on behalf of the Seller u
 p to the reserve\, whether or not the reserve is published. W
 hen preview or inspection is available\, bidders are encourag
 ed to inspect all items before bidding. Public inspection & 
 preview information is posted on our website for each sale. 
 Bid cards and bidder registration numbers are issued solely 
 to individuals and are not transferable. Others are not auth
 orized to use your bidder registration. Should you allow oth
 ers to bid under your number\, you will be fully responsible 
 for all bids they make as though you made them yourself. The
  sale price recorded by the auction clerk on his or her reco
 rd sheets\, either on paper or electronically\, takes priority
  over all other records and shall be the official sale price
  of the item sold. Removal of any and all items shall be at 
 the expense\, liability and risk of the purchaser. All proper
 ty must be removed within the time period announced by the A
 uctioneer for each auction. Property not removed within the 
 announced time period will revert to the Seller for resale o
 r disposal\, without refund or recourse to the bidder. Proper
 ty not removed shall be considered abandoned and no refunds 
 shall be issued. The Seller\, at his or her discretion\, may c
 hose to have unclaimed items removed or disposed of at the e
 xpense of the Bidder who failed to collect the items. By par
 ticipating in this auction\, you agree to pay the removal cos
 ts of any unclaimed items that you won in the auction. You m
 ust remove all items associated with each lot. Leaving behin
 d any items from your purchase will result in a disposal fee
  assessed. Disposal fees range from $25 - $1\,000 depending u
 pon our costs. Announcements made at the time of the sale ta
 ke precedence over conflicting announcements or postings. Th
 e Auctioneer reserves the right to determine bidding increme
 nts at his or her discretion\, and may reject a nominal or fr
 actional bid. The Seller and the Auctioneer reserve the righ
 t to withdraw items from sale before or during the auction w
 ithout prior notice. Persons attending the auction during pr
 eview or inspection period\, the auction\, or during the remov
 al period assume all risks of damage\, injury\, or loss to the
 ir person and or property\, and release the Auctioneer and th
 e Auction Firm from liability thereof. Neither the Auction F
 irm nor its principals shall be liable for any defect in or 
 condition of premises on which the auction is held. The Auct
 ion Firm is acting solely as the agent for the Seller and is
  not responsible for any acts or omissions of its principals
 . The buyer\, associates\, employees\, contractors and guests s
 hall assume all liability for any damage they cause during t
 he inspection or removal process. Should any litigation or m
 ediation be commenced between the parties to this agreement\,
  concerning this agreement or the associated auction\, the bi
 dder / buyer agrees that the court shall award the prevailin
 g party all reasonable costs and expenses\, including reasona
 ble attorney's fees. The bidder / buyer agrees to reimburse 
 the Auctioneer for all expenses incurred in the collection o
 f any unsatisfied debt in conjunction with this auction. Bid
 der agrees that this agreement shall be governed by the laws
  of the state of Colorado and hereby grants sole jurisdictio
 n and agrees to submit to the personal jurisdiction and venu
 e of a court of subject matter jurisdiction located in El Pa
 so County\, Colorado. Both parties waive any right to a jury 
 trial and hereby agree to a bench trial before a judge. This
  agreement shall be governed in all respects by the laws of 
 the State of Colorado. If for any reason\, a court of compete
 nt jurisdiction finds any part of this agreement to be inval
 id or unenforceable\, that part will be enforced to the maxim
 um extent permissible to affect the original intent of this 
 agreement. If a part is found to be invalid or unenforceable
 \, the remainder of this agreement shall continue in full for
 ce and effect. Such invalid or unenforceable part will be de
 emed severable from the other parts here and will not affect
  the validity or enforceability of the remaining parts. Any 
 Bidder who fails to perform as required under these terms an
 d conditions may be banned from this or any future auctions.
  By registering for any auction\, the bidder agrees to be add
 ed to the Auctioneer’s email list. If you choose to unsubs
 cribe\, please follow the link at the bottom of each email to
  update your notifications. The Auctioneer records all live 
 auctions via video\, audio\, still photography\, or a combinati
 on of all three. The Bidder grants the Auctioneer permission
  to use these recordings and or images for any purpose. Paym
 ent Payment is due immediately at the conclusion of the auct
 ion. A 18.5% Buyer’s Premium will be charged to all items\,
  discounted to 15% for cash payments. Visa\, MasterCard\, Disc
 over\, and American Express will be accepted with matching ph
 oto-identification. By participating in this auction\, buyers
  expressly agree that they will not “chargeback” or “d
 eny” a credit card purchase. The 15% Buyer’s Premium sha
 ll apply to all credit card sales. Unless you contact our of
 fice prior to 10:30am the day following the auction with an 
 alternative form of payment\, the credit card that you regist
 er in the online bidding system may be charged at that time 
 for purchases up to $1\,000. There is a $35 service fee that 
 will be assessed for any credit card that is declined for a 
 purchase. Purchases larger than $1\,000 are required to be pa
 id by cash or wire transfer. Wire transfers will be accepted
  from US banks only\, and must be completed by 10:00 AM the m
 orning following the sale. No paperwork will be provided unt
 il the payment posts to our account. Checks will NOT be acce
 pted under any circumstances. Title for any item will not tr
 ansfer until payment posts and clears. Sales Tax Sales taxes
  will be assessed based on where the items are physically lo
 cated. Bidders who wish to claim a sales tax exemption MUST 
 provide a copy of their tax-exemption certificate PRIOR to p
 lacing any bids. Sales taxes will NOT be credited back shoul
 d the bidder fail to pre-register their exemption. An additi
 onal 6.5% excise tax will be collected on firearms and ammun
 ition sales under new laws passed in Colorado.  Pick-Up / S
 hipping Items may be picked up at the seller's facility by a
 ppointment only. Should the auctioneer consent to a delayed 
 pickup time\, buyers may be charged a daily storage fee\, per 
 lot\, to be determined by the Auctioneer. Items not picked up
  during the designated pick-up times will be deemed abandone
 d and will revert back to the Seller with no refunds. Shippi
 ng and Handling Costs: Shipping and handling expenses are ex
 tra and are not included in the bid price of any item. Aucti
 ons winnings must be paid in full before items can be submit
 ted for shipping. Shipping costs are based on size\, weight\, 
 value\, and special conditions (fragile\, hazardous\, etc.). Sh
 ipping is provided and invoiced by Shipping Saint. Retail De
 livery & Administrative Fee: The State of Colorado has manda
 ted that businesses collect a retail delivery fee of .29 per
  invoice for items shipped by vehicle within the state. The 
 state mandates businesses to collect\, track\, report\, and rem
 it this fee with no credit or compensation to the business.
  The cost for us to administer this tax collection is more 
 than four times the actual fee. Therefore\, we must add a $1 
 surcharge\, which includes the fee\, in order to adhere to thi
 s unfunded mandate.  If you do not support this fee\, please
  contact your state representatives.  On-Line Auctions Neit
 her the Auctioneer nor the Seller shall be responsible for a
 ny failure of any electronic or internet systems to accept o
 r register a bid. Registered bidders must create a password 
 that prevents others from using their account. Bidders are r
 esponsible for ALL bids placed under their name and password
 . This is a Public Auction and as such\, all qualified bidder
 s may bid\, including Schur Success owners\, family members an
 d employees. Online auctions use a “Dynamic” ending proc
 ess. If a bid is received in the last few minutes before the
  scheduled closing of an item\, the timer on that item will e
 xtend\, and will continue to extend each time a bid is receiv
 ed. Once the bidding stops\, and the timer runs out\, that ite
 m will be eligible to close. In some cases\, items are “lin
 ked”\, keeping one item open for bidding when a different i
 tem in the auction has been extended due to active bidding. 
 It is the Bidder's responsibility to determine condition\, ag
 e\, genuineness\, value or any other determinative factor of a
 ll items. Auctioneer may attempt to describe the merchandise
  in advertising\, on the internet and at the auction but make
 s no representations. In no event shall the Auctioneer be he
 ld responsible for having made or implied any warranty of me
 rchantability or fitness for a particular purpose. Auctionee
 r does not guarantee any appraisals\, gradings or certificati
 ons. If you have any questions about the merchandise\, ASK YO
 UR QUESTION BEFORE PLACING BIDS. Bidders shall be the sole j
 udges of value. It is Bidder's responsibility to determine i
 f any item is legal where they live. By placing a bid\, Bidde
 r acknowledges that they have inspected the items to their s
 atisfaction or chooses to not examine them at their sole ris
 k. Even though an item may display as "sold" on the internet
 \, no sales are final until they are certified by the Auction
 eer and the bidder receives an invoice. Auctioneer reserves 
 the right to cancel any or all sales and resell the items in
  whatever manner he or she chooses. Bidding increments are a
 utomatically adjusted based on the chart provided for each a
 uction and are subject to change at the sole discretion of A
 uctioneer. Bids cannot and will not be removed or altered\, u
 nless in the opinion of the auctioneer\, the bidder can estab
 lish that the bid was an obvious typographical error. Copyri

 aimer The Auctioneer sells assets on behalf of clients\, and 
 does not endorse or support any given item or cause that may
  be uncomfortable for a certain buyer. Some items may have h
 istorical relevance that outweighs any negative connotations
 . Firearms The Auctioneer holds a current and valid Federal 
 Firearms License (FFL) and will comply with all laws federal
 \, state\, and local. Though we may sell firearms that are leg
 al in our jurisdiction\, they may not be legal in the bidder
 s jurisdiction. It is the sole responsibility and obligati
 on of the buyer to ensure the legality of a firearm in their
  jurisdiction. A thirty percent (30%) restocking fee will ap
 ply if a firearm purchased cannot be possessed in the buyer
 s jurisdiction and must be returned to our inventory. Fire
 arms must be picked up in person at our office in Monument\, 
 Colorado\, or they can be shipped to an FFL dealer of the bid
 der’s choosing. Firearms shipped will incur shipping and h
 andling charges as outlined above. Firearms and all associat
 ed shipping and handling costs must be paid prior to shippin
 g. The buyer is solely responsible for complying with firear
 ms laws in the jurisdiction where the firearms will be recei
 ved. The buyer must notify the recipient FFL dealer of the t
 ransaction before the Auctioneer makes any shipping arrangem
 ents. Buyers wishing to pick up firearms in our office must 
 make an appointment. Buyers will be subject to a mandatory C
 BI background check for each auction\, though multiple firear
 ms bought at the same time will require only one such check.
  The buyer will pay the cost of the background check ($15.00
 ) as required by CBI. Valid identification will be required.
  Contact the auction to determine if your identification is 
 acceptable. Purchases must be paid in full prior to a backgr
 ound check being conducted. If a buyer fails a background ch
 eck\, the Auctioneer shall retain the firearms and refund the
  purchase price less a thirty-percent (30%) restocking fee. 
 Firearms will be sold ONLY to the registered bidder. They wi
 ll not be sold to another person\, nor will a name be changed
  on any forms including bidder registrations or invoices. If
  you attempt to change a transaction to a different person\, 
 that is considered a straw purchase. If you know you will no
 t pass a background check\, do not bid. Straw purchases are a
 bsolutely forbidden. If the Auctioneer has any reason to sus
 pect that a firearm will be given/sold/transferred illegally
  to a third party\, he must\, by law\, refuse the sale and repo
 rt his suspicions to the proper authorities. Straw purchases
  are a federal offense. Used firearms are sold untested. We 
 do not attempt to fire or test any weapon that we sell. We h
 ighly recommend that you have all used firearms inspected by
  a qualified professional before operating.
