Bidder agrees tha t this agreement shall be governed by the laws of the state of Colorado and hereby grants sole jurisdiction and agrees t o submit to the personal jurisdiction and venue of a court o f subject matter jurisdiction located in El Paso County\, Col orado. Both parties waive any right to a jury trial and here by agree to a bench trial before a judge. This agreement sha ll be governed in all respects by the laws of the State of C olorado. If for any reason\, a court of competent jurisdictio n finds any part of this agreement to be invalid or unenforc eable\, that part will be enforced to the maximum extent perm issible to affect the original intent of this agreement. If a part is found to be invalid or unenforceable\, the remainde r of this agreement shall continue in full force and effect. Such invalid or unenforceable part will be deemed severable from the other parts here and will not affect the validity or enforceability of the remaining parts. The Bidder grants the Auctioneer permission to use these recordings and or images for any purpose. Payment Payment is due immediately at the conclusion of the auction. An 18.5% Buyer’s Premium will be charged to all items\, with an opti onal cash discount of 3.5%. Visa\, MasterCard\, Discover\, and American Express will be accepted with matching photo-identi fication. By participating in this auction\, buyers expressly agree that they will not “chargeback” or “deny” a c redit card purchase. The 18.5% Buyer’s Premium shall apply to all credit card sales. Shipping and Handling Co sts: SHIPPING IS AVAILABLE FOR THIS AUCTION Shipping and han dling expenses are extra and are not included in the bid pri ce of any item. Auction winnings must be paid in full before items can be submitted for shipping. Shipping costs are bas ed on size\, weight\, value\, and special conditions (fragile\, hazardous\, etc.).  Shipping is provided and invoiced by Shi pping Saint.  Retail Delivery & Administrative Fee: The St ate of Colorado has mandated that businesses collect a reta il delivery fee of .29 per invoice for items shipped by vehi cle within the state. The state mandates businesses to colle ct\, track\, report\, and remit this fee with no credit or comp ensation to the business.  The cost for us to administer th is tax collection is more than four times the actual fee. Th erefore\, we must add a $1 surcharge\, which includes the fee\, in order to adhere to this unfunded mandate.  If you do n ot support this fee\, please contact your state representativ es. On-Line Auctions Neither the Auctioneer nor the Seller s hall be responsible for any failure of any electronic or int ernet systems to accept or register a bid. Registered bidder s must create a password that prevents others from using the ir account. Bidders are responsible for ALL bids placed unde r their name and password.
