Property not removed within the announced time period will revert to the Seller for resale or disposal\, wi thout refund or recourse to the bidder. The Seller\, at his or her discretion\, may chose to have u nclaimed items removed or disposed of at the expense of the Bidder who failed to collect the items. By participating in this auction\, you agree to pay the removal costs of any uncl aimed items that you won in the auction. You must remove all items associated with each lot. Leaving behind any items fr om your purchase will result in a disposal fee assessed. Dis posal fees range from $25 - $1\,000 depending upon our costs. Announcements made at the time of the sale take precedence over conflicting announcements or postings. The bidder / buyer agrees to reimburse the Auctione er for all expenses incurred in the collection of any unsati sfied debt in conjunction with this auction. Bidder agrees t hat this agreement shall be governed by the laws of the stat e of Colorado and hereby grants sole jurisdiction and agrees to submit to the personal jurisdiction and venue of a court of subject matter jurisdiction located in El Paso County\, C olorado. Both parties waive any right to a jury trial and he reby agree to a bench trial before a judge. This agreement s hall be governed in all respects by the laws of the State of Colorado. If for any reason\, a court of competent jurisdict ion finds any part of this agreement to be invalid or unenfo rceable\, that part will be enforced to the maximum extent pe rmissible to affect the original intent of this agreement. I f a part is found to be invalid or unenforceable\, the remain der of this agreement shall continue in full force and effec t. Such invalid or unenforceable part will be deemed severab le from the other parts here and will not affect the validit y or enforceability of the remaining parts. Any Bidder who f ails to perform as required under these terms and conditions may be banned from this or any future auctions. By register ing for any auction\, the bidder agrees to be added to the Au ctioneer’s email list. The Auctioneer records all live auctions via video\, audio\, still photography\, or a combination of all th ree. The Bidder grants the Auctioneer permission to use thes e recordings and or images for any purpose. Payment Payment is due immediately at the conclusion of the auction. A 18.5% Buyer’s Premium will be charged to all items\, reduced to 15% for cash purchases. Visa\, MasterCard\, Discover\, and Amer ican Express will be accepted with matching photo-identifica tion. By participating in this auction\, buyers expressly agr ee that they will not “chargeback” or “deny” a credi t card purchase. The 18.5% Buyer’s Premium shall apply to all credit card sales. Unless you contact our office prior t o 10:00am the day following the auction with an alternative form of payment\, the credit card that you register in the on line bidding system may be charged at that time for purchase s up to $1\,000. There is a $35 service fee that will be asse ssed for any credit card that is declined for a purchase. Pu rchases larger than $1\,000 are required to be paid by cash o r wire transfer. Wire transfers will be accepted from US ban ks only\, and must be completed by 10:00 AM the morning follo wing the sale. No paperwork will be provided until the payme nt posts to our account. Checks will NOT be accepted under a ny circumstances. Title for any item will not transfer until payment posts and clears. Sales Tax Sales taxes will be ass essed based on where the items are physically located. Bidde rs who wish to claim a sales tax exemption MUST provide a co py of their tax-exemption certificate PRIOR to placing any b ids. Sales taxes will NOT be credited back should the bidder fail to pre-register their exemption. Pick-Up / Shipping It ems may be picked up at the seller's facility by appointment only. Should the auctioneer consent to a delayed pickup tim e\, buyers may be charged a daily storage fee\, per lot\, to be determined by the Auctioneer. Shipping and Han dling Costs: SHIPPING IS AVAILABLE FOR THIS AUCTION Shipping and handling expenses are extra and are not included in the bid price of any item. Auction winnings must be paid in ful l before items can be submitted for shipping. Shipping costs are based on size\, weight\, value\, and special conditions (f ragile\, hazardous\, etc.).  Shipping is provided and invoice d by Shipping Saint.  Retail Delivery & Administration Fee: The State of Colorado has mandated that businesses collect a retail delivery fee of .29 per invoice for items shipped b y vehicle within the state. The state mandates businesses to collect\, track\, report\, and remit this fee with no credit o r compensation to the business.  The cost for us to adminis ter this tax collection is more than four times the actual f ee. Therefore\, we must add a $1 surcharge\, which includes th e fee\, in order to adhere to this unfunded mandate.  If you do not support this fee\, please contact your state represen tatives.  On-Line Auctions Neither the Auctioneer nor the S eller shall be responsible for any failure of any electronic or internet systems to accept or register a bid. Registered bidders must create a password that prevents others from us ing their account. Bidders are responsible for ALL bids plac ed under their name and password. This is a Public Auction a nd as such\, all qualified bidders may bid\, including Schur S uccess owners\, family members and employees. Online auctions use a “Dynamic” ending process.
