The bidder / buyer agrees to reimburse the Auctioneer for all expenses incurred in the collection of a ny unsatisfied debt in conjunction with this auction. Bidder agrees that this agreement shall be governed by the laws of the state of Colorado and hereby grants sole jurisdiction a nd agrees to submit to the personal jurisdiction and venue o f a court of subject matter jurisdiction located in El Paso County\, Colorado. Both parties waive any right to a jury tri al and hereby agree to a bench trial before a judge. This ag reement shall be governed in all respects by the laws of the State of Colorado. If for any reason\, a court of competent jurisdiction finds any part of this agreement to be invalid or unenforceable\, that part will be enforced to the maximum extent permissible to affect the original intent of this agr eement. If a part is found to be invalid or unenforceable\, t he remainder of this agreement shall continue in full force and effect. Such invalid or unenforceable part will be deeme d severable from the other parts here and will not affect th e validity or enforceability of the remaining parts. Any Bid der who fails to perform as required under these terms and c onditions may be banned from this or any future auctions. By registering for any auction\, the bidder agrees to be added to the Auctioneer’s email list. The Auctioneer records all live auc tions via video\, audio\, still photography\, or a combination of all three. The Bidder grants the Auctioneer permission to use these recordings and or images for any purpose. Payment Payment is due immediately at the conclusion of the auction . A 18.5% Buyer’s Premium will be charged to all items\, re duced to 15% for cash purchases. Visa\, MasterCard\, Discover\, and American Express will be accepted with matching photo-i dentification. By participating in this auction\, buyers expr essly agree that they will not “chargeback” or “deny†ť a credit card purchase. The 18.5% Buyer’s Premium shall apply to all credit card sales. Unless you contact our offic e prior to 10:00am the day following the auction with an alt ernative form of payment\, the credit card that you register in the online bidding system may be charged at that time for purchases up to $1\,000. There is a $35 service fee that wil l be assessed for any credit card that is declined for a pur chase. Purchases larger than $1\,000 are required to be paid by cash or wire transfer. Wire transfers will be accepted fr om US banks only\, and must be completed by 10:00 AM the morn ing following the sale. No paperwork will be provided until the payment posts to our account. Checks will NOT be accepte d under any circumstances. Title for any item will not trans fer until payment posts and clears. Sales Tax Sales taxes wi ll be assessed based on where the items are physically locat ed. Bidders who wish to claim a sales tax exemption MUST pro vide a copy of their tax-exemption certificate PRIOR to plac ing any bids. Sales taxes will NOT be credited back should t he bidder fail to pre-register their exemption. Pick-Up / Sh ipping Items may be picked up at the seller's facility by ap pointment only. Shippin g and Handling Costs: SHIPPING IS AVAILABLE FOR THIS AUCTION Shipping and handling expenses are extra and are not includ ed in the bid price of any item. Auction winnings must be pa id in full before items can be submitted for shipping. Shipp ing costs are based on size\, weight\, value\, and special cond itions (fragile\, hazardous\, etc.).  Shipping is provided an d invoiced by Shipping Saint.  Retail Delivery & Administra tion Fee: The State of Colorado has mandated that businesses collect a retail delivery fee of .29 per invoice for items shipped by vehicle within the state. The state mandates busi nesses to collect\, track\, report\, and remit this fee with no credit or compensation to the business.  The cost for us t o administer this tax collection is more than four times the actual fee. Therefore\, we must add a $1 surcharge\, which in cludes the fee\, in order to adhere to this unfunded mandate.   If you do not support this fee\, please contact your state representatives.  On-Line Auctions Neither the Auctioneer nor the Seller shall be responsible for any failure of any e lectronic or internet systems to accept or register a bid. R egistered bidders must create a password that prevents other s from using their account. Bidders are responsible for ALL bids placed under their name and password. This is a Public Auction and as such\, all qualified bidders may bid\, includin g Schur Success owners\, family members and employees. Online auctions use a “Dynamic” ending process.
