Bot h parties waive any right to a jury trial and hereby agree t o a bench trial before a judge. This agreement shall be gove rned in all respects by the laws of the State of Colorado. I f for any reason\, a court of competent jurisdiction finds an y part of this agreement to be invalid or unenforceable\, tha t part will be enforced to the maximum extent permissible to affect the original intent of this agreement. If a part is found to be invalid or unenforceable\, the remainder of this agreement shall continue in full force and effect. Such inva lid or unenforceable part will be deemed severable from the other parts here and will not affect the validity or enforce ability of the remaining parts. Any Bidder who fails to perf orm as required under these terms and conditions may be bann ed from this or any future auctions. The Auctioneer records all live auctions via video\, audi o\, still photography\, or a combination of all three. The Bid der grants the Auctioneer permission to use these recordings and or images for any purpose. Payment Payment is due immed iately at the conclusion of the auction. A 18.5% Buyer’s P remium will be charged to all items\, reduced to 15% for cash purchases. Visa\, MasterCard\, Discover\, and American Express will be accepted with matching photo-identification. By par ticipating in this auction\, buyers expressly agree that they will not “chargeback” or “deny” a credit card purch ase. The 18.5% Buyer’s Premium shall apply to all credit c ard sales. Unless you contact our office prior to 10:00am th e day following the auction with an alternative form of paym ent\, the credit card that you register in the online bidding system may be charged at that time for purchases up to $1\,0 00. There is a $35 service fee that will be assessed for any credit card that is declined for a purchase. Purchases larg er than $1\,000 are required to be paid by cash or wire trans fer. Wire transfers will be accepted from US banks only\, and must be completed by 10:00 AM the morning following the sal e. No paperwork will be provided until the payment posts to our account. Checks will NOT be accepted under any circumsta nces. Title for any item will not transfer until payment pos ts and clears. Sales Tax Sales taxes will be assessed based on where the items are physically located. Bidders who wish to claim a sales tax exemption MUST provide a copy of their tax-exemption certificate PRIOR to placing any bids. Shipping and Handling Costs: SHIPPING IS AVAILABLE FOR THIS AUCTION Shipping and handlin g expenses are extra and are not included in the bid price o f any item. Auction winnings must be paid in full before ite ms can be submitted for shipping. Shipping costs are based o n size\, weight\, value\, and special conditions (fragile\, haza rdous\, etc.).  Shipping is provided and invoiced by Shippin g Saint.  Retail Delivery & Administration Fee: The State o f Colorado has mandated that businesses collect a retail del ivery fee of .29 per invoice for items shipped by vehicle wi thin the state. The state mandates businesses to collect\, tr ack\, report\, and remit this fee with no credit or compensati on to the business.  The cost for us to administer this tax collection is more than four times the actual fee. Therefor e\, we must add a $1 surcharge\, which includes the fee\, in or der to adhere to this unfunded mandate.  If you do not supp ort this fee\, please contact your state representatives.  O n-Line Auctions Neither the Auctioneer nor the Seller shall be responsible for any failure of any electronic or internet systems to accept or register a bid. Registered bidders mus t create a password that prevents others from using their ac count. Bidders are responsible for ALL bids placed under the ir name and password.
