The Seller\, at his or her discretion\, may chose to have unclaimed items removed or disposed of at the expense of the Bidder who failed to collect the items. Leaving behind any i tems from your purchase will result in a disposal fee assess ed. Disposal fees range from $25 - $1\,000 depending upon our costs. The bidder / buyer agrees to reimburse the A uctioneer for all expenses incurred in the collection of any unsatisfied debt in conjunction with this auction. Bidder a grees that this agreement shall be governed by the laws of t he state of Colorado and hereby grants sole jurisdiction and agrees to submit to the personal jurisdiction and venue of a court of subject matter jurisdiction located in El Paso Co unty\, Colorado. Both parties waive any right to a jury trial and hereby agree to a bench trial before a judge. This agre ement shall be governed in all respects by the laws of the S tate of Colorado. If for any reason\, a court of competent ju risdiction finds any part of this agreement to be invalid or unenforceable\, that part will be enforced to the maximum ex tent permissible to affect the original intent of this agree ment. If a part is found to be invalid or unenforceable\, the remainder of this agreement shall continue in full force an d effect. Such invalid or unenforceable part will be deemed severable from the other parts here and will not affect the validity or enforceability of the remaining parts. Any Bidde r who fails to perform as required under these terms and con ditions may be banned from this or any future auctions. The Auctioneer records all live aucti ons via video\, audio\, still photography\, or a combination of all three. The Bidder grants the Auctioneer permission to u se these recordings and or images for any purpose. Payment P ayment is due immediately at the conclusion of the auction. A 18.5% Buyer’s Premium will be charged to all items\, redu ced to 15% for cash purchases. Visa\, MasterCard\, Discover\, a nd American Express will be accepted with matching photo-ide ntification. By participating in this auction\, buyers expres sly agree that they will not “chargeback” or “deny” a credit card purchase. The 18.5% Buyer’s Premium shall ap ply to all credit card sales. Unless you contact our office prior to 10:00am the day following the auction with an alter native form of payment\, the credit card that you register in the online bidding system may be charged at that time for p urchases up to $500. There is a $35 service fee that will be assessed for any credit card that is declined for a purchas e. Purchases larger than $500 are required to be paid by ca sh or wire transfer. Wire transfers will be accepted from US banks only\, and must be completed by 10:00 AM the morning f ollowing the sale. No paperwork will be provided until the p ayment posts to our account. Checks will NOT be accepted und er any circumstances. Title for any item will not transfer u ntil payment posts and clears. Sales Tax Sales taxes will be assessed based on where the items are physically located. B idders who wish to claim a sales tax exemption MUST provide a copy of their tax-exemption certificate PRIOR to placing a ny bids. Sales taxes will NOT be credited back should the bi dder fail to pre-register their exemption. Pick-Up / Shippin g Items may be picked up at the seller's facility by appoint ment only. Shipping and Handling Costs: SHIPPING IS AVAILABLE FOR THIS AUCTION Ship ping and handling expenses are extra and are not included in the bid price of any item. Auction winnings must be paid in full before items can be submitted for shipping. Shipping c osts are based on size\, weight\, value\, and special condition s (fragile\, hazardous\, etc.).  Shipping is provided and inv oiced by Shipping Saint.  Retail Delivery & Administration Fee: The State of Colorado has mandated that businesses coll ect a retail delivery fee of .29 per invoice for items shipp ed by vehicle within the state. The state mandates businesse s to collect\, track\, report\, and remit this fee with no cred it or compensation to the business.  The cost for us to adm inister this tax collection is more than four times the actu al fee. Therefore\, we must add a $1 surcharge\, which include s the fee\, in order to adhere to this unfunded mandate.  If you do not support this fee\, please contact your state repr esentatives.  On-Line Auctions Neither the Auctioneer nor t he Seller shall be responsible for any failure of any electr onic or internet systems to accept or register a bid. Regist ered bidders must create a password that prevents others fro m using their account. Bidders are responsible for ALL bids placed under their name and password. This is a Public Aucti on and as such\, all qualified bidders may bid\, including Sch ur Success owners\, family members and employees. Online auct ions use a “Dynamic” ending process. If a bid is receive d in the last few minutes before the scheduled closing of an item\, the timer on that item will extend\, and will continue to extend each time a bid is received. In some cases\, items are “linked”\, keeping one item open for bidding when a different item in the auction has b een extended due to active bidding.
